On Wednesday afternoon, Dzhokhar Tsarnaev was found guilty of all 30 charges against him involving the 2013 Boston Marathon bombing, which took three lives and injured at least 280, and a subsequent crime spree, which claimed the life of an officer of MIT campus. Among those charges were murder and the use of weapons of mass destruction. 17 of the 30 guilty charges were death penalty-eligible, and so because Tsarnaev was convicted of even one of them, he will now move into a penalty phase where the jurors will weigh whether to sentence him to death. During the “penalty phase,” which is expected to begin almost immediately, the prosecution will present “aggravating circumstances” in favor of sentencing Tsarnaev to death over a life in jail. Conversely, the defense will present their “mitigating circumstances” that they believe suggest he should get a life sentence rather than the electric chair. It is during this phase that we will expect to hear more “ victim impact statements ” — from a lot of people who have already testified — as part of the prosecution’s emotional appeal for a death penalty. Should the jury be unable to reach a unanimous decision to sentence Tsarnaev to death, the sentencing will automatically revert to life in prison without possibility of parole. And if he is sentenced to death, expect the defense to appeal the decision in coming months.
